This Day That Age
The Law Minister, Mr. C. C. Biswas, agreed in the Lok Sabha on September 1 to restore the age of marriage under the Special Marriage Bill to 18 and re-draft the clause relating to divorce by consent. The Rajya Sabha had raised the age of marriage to 21. Mr. Biswas said that, when under the ordinary law a person was competent to enter into any form of contract on attaining the age of 18, there was hardly any reason why he should be made to wait till he had attained the age of 21 for the purpose of marriage. In India, women matured earlier and, therefore, to make them wait till they attained the age of 21 would not be very desirable. However, it should be provided that if the parties to the marriage were between the ages of 18 and 21, the consent of the guardian should be obtained. As regards divorce by consent, Mr. Biswas suggested that perhaps if the clause was re-drafted so as to provide that the application to the court should be made jointly and that after the application a period was allowed to retrace one's step, the clause would be more acceptable.
