High Court Bench grants bail to clerk

MADURAI, SEPT.5. The Madurai Bench of the Madras High Court on Friday granted bail to a suspended assistant (clerk) attached to the office of the District Elementary Education Officer in Thanjavur. He was arrested in connection with the Kumabakonam fire incident, which took 94 lives, on July 16. The clerk, S. Sivaprakasam, was arrested on July 21 and sent to judicial custody.

The allegation against him was that he made an office note to the DEEO that the records pertaining to the recognition of Saraswathi Nursery and Primary school at Kumbakonam were satisfactory.

He received the records from the AEEO with due recommendation and inspection report.

Arguing for the petitioner, his counsel, S. Nagamuthu, stated that the petitioner was not the authority to inspect or pass any order.

"He is duty-bound only to verify the records and make an office note to the DEEO. And it is the DEEO who has to use his discretion and pass orders. Hence, he cannot be held responsible in any manner for the fire accident," he said.
