CHENNAI, SEPT. 9. The City Public Prosecutor, who has already informed a sessions court here of the withdrawal of two defamation proceedings against The Hindu , today filed an additional petition stating that the Government had decided to withdraw "deserving cases" against the media. In the additional petition seeking permission to withdraw the prosecution under Section 321 of the Code of Criminal Procedure, he said though the article in question was "defamatory in nature, the Government has now taken a decision to withdraw the complaint with a view that the media and newspapers would faithfully adhere unflinchingly to the essential principles of correct reporting." It also claimed "nowadays false, frivolous and derogatory statements against Ministers of the State and public servants in respect of their conduct in the discharge of their public functions and duties are not published." Stating "positive changes in the circumstances have taken place," the CPP said, "the Government believes that the media and the Press will respond positively by publishing unbiased reporting, thereby upholding the best tradition of journalistic ethics." He further said sanction orders for the withdrawal of the complaints were issued "as a gesture of goodwill." Pointing out that the Tamil Nadu Government had told the Supreme Court about the withdrawal of defamation cases against newspapers and the media recently, the CPP sought permission to withdraw prosecution "to bring about a conducive atmosphere." The CPP, however, did not furnish the copy of the June 16, 2004 "common" Government Order Ms. No. 843 sanctioning the withdrawal of defamation proceedings against The Hindu . The III Additional Sessions Judge, Ramalingam, posted the matter to Friday for further hearing.
