Court restrains eviction of farmer

MADURAI, SEPT. 10. The Madurai Bench of the Madras High Court today restrained the district authorities from evicting a farmer from the agricultural land granted to him under the Bhoodan Yagna Movement in 1961.

The court granted the interim injunction, admitting a writ petition filed by P. Karuppan of Dindigul.

In his petition, the farmer said he had been granted the land under the Tamil Nadu State Bhoodan Yagna Act, 1958. The Act was meant to protect and promote the Movement, which was initiated by Acharya Vinoba Bhave for receiving land from the public as gifts and distribute it to the landless poor.

He said a Bhoodan Committee, which subsequently got converted into Tamil Nadu Bhoodan Yagna Board, granted him the land measuring 0.42 hectares in two different survey numbers, nearly 42 years ago. But suddenly, following a communication from the Collector's office, the authorities had been forcing him to vacate the land, labelling him an encroacher, he alleged.

The farmer's counsel, K.R. Laxman, said his client had been strictly following the conditions as per Section 15 (1) of the Tamil Nadu Bhoodan Yagna Act, 1958, for all these years and hence, there was no substantial ground to evict him.

"As the grant of land was by way of issuance of a document by the Bhoodan Committee, my client's interests are solid and the same cannot be lightly touched or interfered with," he said.

Following this, the court granted the interim injunction and adjourned the matter for further hearing.
