Contempt petition against Dalmiya

BHOPAL, SEPT. 13. A day after Jagmohan Dalmiya was appointed the Board of Control for Cricket in India's (BCCI) first-ever Patron-in-Chief, an application terming it a contempt of court was moved in a court here today.

The Civil Judge, P. K. Nigam, reserved the verdict on an application by the Bhopal Cricket Association member, Yogesh Khattar, till tomorrow. He asked the Board to reply by September 20 on the legality of the proposal. Mr. Khattar's counsel, Ajay Gupta, had earlier challenged the proposal, claiming that appointing a Patron-in-Chief was outside the BCCI's rulebook.

The Judge, on September 10, had restrained the BCCI from taking any decision on the proposal, contrary to its rules and regulations.

Mr. Gupta, who was asked to revise the application to suit technical standards earlier in the day, alleged that the appointment violated the court's interim order and demanded contempt proceedings against the BCCI and its office-bearers including Mr. Dalmiya, who will be the Board president till September 29.

The court observed that a fresh suit was called for and reserved its verdict till tomorrow.

Mr. Gupta also sought the details of the resolution passed at the BCCI meeting in Chennai.

The court, which had issued notices to the BCCI, the Madhya Pradesh Cricket Association and others for a reply today, posted the hearing to September 20 as the BCCI advocate, Gaurav Chhabra, sought 10 days to reply.

`Notices not served'

Claiming that the notices were not served and he was present to take cause, Mr. Chhabra informed the court that he officially collected them today and would need some time to reply since the respondents were in Chennai. "Since the resolution of Dalmiya's appointment has already been passed, there is no urgency," he said. — PTI
