Order promoting two court officers set aside

BANGALORE, SEPT. 14. The Karnataka High Court has set aside an administrative order issued by its Chief Justice temporarily promoting two court officers as assistant registrars.

A Division Bench comprising Justice B. Padmaraj and Justice H. Billappa partly allowed petitions by C. Chenne Gowda and K.V. Saraswati, court officers, and quashed the notification of the Registrar-General (High Court) promoting Narasa Reddy and V. Vijaya Prabhakar (respondents) as assistant registrars.

The petitioners said their seniority was overlooked and their juniors were promoted. They joined service as stenographers and were promoted as judgment writers and later as court officers.

Six posts of assistant registrar were vacant and they were to be filled by promotion from the cadre of court officers. The petitioners were senior-most in that cadre and they did not have any adverse remark against them in their annual confidential reports.

They said the Chief Justice issued a memo on August 28, 2003 asking them to appear for an interview before him. The memo stated neither the number of posts for which the promotions were being considered nor the rule under which the interview was being conducted.

Ten senior judgment writers, eight court officers, and five section officers appeared for the interview on September 2, 2003.

Notice

The High Court on Tuesday ordered issue of notice to the State Government and others on a petition by a councillor of the Bommanahalli City Municipal Council (CMC).

The petitioner, Krishnappa, said election of the President and Vice-President of the CMC was scheduled for Wednesday. The CMC had 31 members apart from the three MLCs nominated by the Government. Though the MLCs, Umashree, L. Hanumanthaiah and B.A. Hasanabba, were residents of Bangalore, they had been permitted to vote in the election.

On September 8, a single judge rejected the petition. The petitioner urged the court to set aside the order of the single judge and declare that the MLCs did not have the right to vote.

A Division Bench comprising the Chief Justice, N.K. Jain, and Justice V.G. Sabhahit ordered issue of notice returnable in 12 weeks. It said no direction could be issued without hearing the respondents.

Dismissed

The Bench dismissed petitions by the Lakshmiranga Mahila Seva Sangha and the Rajarajeshwari Mahila Seva Sangha.

The petitioners had appealed to the court to direct the Department of Health and Family Welfare not to shift the primary healthcare unit at Ganigarapet, Banappa Park, to Rajankunte in Bangalore North.

They said the residents of the area would be affected if the unit was shifted.

Stayed

Justice D.V. Shylendra Kumar stayed a notification of the Government modifying the reservation for the posts of President and Vice-President of the Ranebennur City Municipal Council (CMC).

In their petitions, Ramappa and Jayashri, councillors, said the modification issued on September 9 was against law, illegal and unconstitutional.

Adjourned

A Division Bench comprising Justice P. Vishwanath Shetty and Justice K. Bhaktavatsala of the Karnataka High Court on Monday adjourned to September 28 hearing of a contempt petition by ING Vysya Bank against the former Commissioner of Bangalore Development Authority (BDA), Jayakar Jerome.

ING Vysya had charged Mr. Jerome and the BDA on two counts of contempt. In its petition, the bank said the BDA had demolished the official residence of its chairman and managing director in Jayanagar 5th Block here even as a stay order was in force.

The High Court had framed the contempt charges and commenced examination of witnesses.
