NEW DELHI, SEPT. 27 .A Delhi court today posted for October 1 the hearing of an application by Bharti Yadav, daughter of the former Member of Parliament, D. P. Yadav, seeking stay of a non-bailable arrest warrant against her in the Nitish Katara murder case. The Additional Sessions Judge, J. M. Malik, posted the hearing on October 1 saying that the Delhi High Court had recently passed an order on a joint application by Vikas Yadav, the main accused in the case, and Ms. Bharti, seeking a direction to the trial court for sending a Court Commission to London or arranging video conferencing on their account for recording of statement of Bharti, a key witness in the case, and the copy of the same had not reached the trial court. The High Court had last week dismissed the plea by the two saying that there was no need to interfere in the trial court order which had dismissed their plea. Rejecting the plea, Justice S.K. Aggarwal, had said that there was no infirmity in the trial court order. The trial court this past July asked Ms. Bharti to appear before it or face non-bailable arrest warrant (NBW) in the case. Mr. Malik, conducting trial of the case, had directed Ms. Bharti to appear before the court on September 27 failing which she would be served with an NBW for October 27. Seeking stay of the NBW, counsel for Ms. Bharti submitted that she was not medically fit to fly in here and record her statement in the court. The prosecution accuses Ms. Bharti of avoiding her appearance before the trial court to record her statement in the case. The prosecution believes that her examination will help unravel the motive behind the killing of Nitish Katara, son of a senior Indian Administrative Service (IAS) officer. Vikas Yadav and Vishal Yadav, son and nephew of D.P. Yadav, are facing trial for allegedly kidnapping and later killing Nitish Katara in Ghaziabad in February 2002.
