Takeover of castle challenged

KOCHI, SEPT. 27 . The Kerala High Court today adjourned to September 28 the hearing on a writ petition filed by Mfar Hotels Ltd. challenging the Government order taking over the possession of the Halcyon Castle.

In the petition, the M-Far Hotel management group contended that the Sate Government had no right or power to take over the hotel, which had been sold to the group. The property had been given to the petitioner by the Union Government and the India Tourism Development Corporation (ITDC). The petitioner could not be deprived of its property merely on the basis of an executive order. In fact, the Government had sold the Halcyon Castle and its adjoining areas to the ITDC for a consideration of Rs.9.50 lakhs in 1970.

The ITDC had been in possession of the building and its property since 1970. The Government, therefore, could not forcibly take over the possession of the property. Besides, no notice had been issued to the petitioner before passing such an order. Thus, the Government had violated the principle of natural justice. Even if the Government was of the view that the petitioner had encroached upon the property, proceeding under the Kerala Public Premises Eviction of Unauthorised Persons Act should have been initiated, the petitioner contended.

Directive to police

Justice R. Basant has directed Vahid, Ponnani CI, and P.A. Varghese, ASI, Perumpadappu Police Station in Malappuram, to appear in person before the court to explain why proceedings under the contempt of court act should not be initiated. The direction came on a petition filed by Abdulakutty P. of Malappuram. Despite the grant of anticipatory bail by the High Court, the petitioner was arrested and kept in police custody. The court said that prima facie the police officers had committed contempt of court.

Writ on grading closed

The writ petition seeking a direction to the Government to reintroduce grading system for the SSLC examination was closed in the view of the submission by the Additional Advocate General that the Government had already re-introduced the system with some modifications.
