Governing councils: Anna varsity fiat to colleges stayed

CHENNAI, OCT. 15. The Madras High Court today yesterday stayed an Anna University order of October 5, directing unaided engineering colleges in the State to constitute Governing Councils by October 25.

Justice D. Murugesan granted the interim stay on a writ petition filed by the All India Medical and Engineering Colleges Association president, T.D. Naidu.

Besides framing statutes and regulations for forming such councils in colleges, the university had also stipulated their composition and functions.

Under the challenged provisions, each council would comprise a chairman and members drawn from various fields, including the university and the affiliated colleges. Designated as "supreme administrative authority," the Councils were to monitor academic and other related activities of the college concerned; implementation of policy decisions of the university and the All-India Council for Technical Education; student and faculty development programmes; and to pass annual budget of colleges.

Describing them as "unreasonable and unacceptable restrictions," the petitioner said that the Supreme Court had repeatedly held that unaided professional colleges were entitled to total administrative autonomy.

He said, "Bureaucratic and governmental interference in the administration of institutions will undermine their independence," and added that the impugned provisions took away their fundamental rights establishing and administering colleges.

In his order, Mr. Justice Murugesan said, "In view of the Supreme Court orders, statute 5.2 and Regulations 1.1 to 1.5 in respect of the constitution of the Governing Council and Members of the Council is prima facie held to be unreasonable restriction. Accordingly, there will be an interim stay."
