School row: court orders fresh board meeting

THIRUVANANTHAPURAM, OCT. 16. The Thiruvananthapuram District Judge, K. Sasidharan Nair, has allowed the former Accountant General, James K. Joseph, to function as the managing trustee of the Resurgent Kerala Educational and Charitable Trust, but has directed him to convene a meeting of the present board of trustees within one month for the appointment of a new Managing Trustee.

The case had attracted much public attention as Mr. Joseph was pitted against the senior IAS officer, Alphons Kannanthanam, in a row over control of the institution.

Allegations

The two sides had traded charges publicly and accused each other of misappropriation of funds and fraud. The District Judge handed down the latest order on October 4 while disposing of an appeal filed by Roy K. Joseph, Mr. Kannamthananm's brother, against a Munsiff Court order in the case.

The District Judge observed as follows: "In view of the allegations and counter- allegations including that of misappropriation, fraud, etc., raised by the rival parties and on account of the reason that the meeting held on 16.6.2003 was not duly convened as contemplated by clause 8(s) and (b) of the Trust deed, and also due to the reason that there is a clear division among the trustees, the interest of the trust as well as of the persons who had made substantial contributions can be safeguarded only by appointing a Managing Trustee at a duly convened meeting of the trust board."
