HYDERABAD, OCT. 25. The writ petition filed challenging the construction of irrigation project at Pulichintala has been adjourned to Wednesday to facilitate the Government filing its counter affidavit. The Division Bench of the Andhra Pradesh High Court comprising the Chief Justice, Devinder Gupta, and the Judge, C. V. Ramulu, was dealing with a writ petition filed by Venkata Reddy and others complaining that without appropriate statutory environmental clearance the Government was going ahead with construction of the project. When the case came up for hearing Senior Counsel Prakash Reddy brought to the notice of the court that the public hearing, which must precede the environmental clearance, was being held on November 10 whereas the works were being taken up. The Advocate General sought two days to file a counter affidavit. The Division Bench speaking through the Chief Justice adjourned the matter to Wednesday making it clear that if no counter affidavit was filed appropriate inferences would be drawn. Several counsel brought to the notice of the court that they filed petitions to implead themselves to oppose the writ petition. The bench said that all the counsel who filed papers, which were in order would be given an opportunity to be heard on Wednesday. At this juncture, it was brought tot he notice of the court that a contempt case had been filed alleging that the undertaking given by the State Government on the earlier ground of litigation was being flouted. The Bench directed that the contempt case be listed for Wednesday.
