UDUPI, NOV. 4. The Second Additional Civil Judge (Junior Division), Udupi, P.G. Chaluvamurthy, has restrained the seer of Jagadguru Revanasidheshwar Mahamath, Basavaraja Devaru, and his followers from entering Udupi city during their `Kanaka Gopura Sangharsha Yatra,' which is expected to begin from Dharwad on November 5, and culminate in Udupi on November 15. In a press release issued here on Thursday, the Paryaya Admar Math said that in response to a suit filed by Vishwapriya Tirtha Swamiji of the Admar Math in this connection, the court had issued a temporary injunction. The order of the court dated November 3, sent along with the press release, stated that the court had perused the documents submitted by the plaintiff (Vishwapriya Tirtha Swamiji). "The documents would reveal that the Sri Krishna Math belongs to the Ashta Maths of Udupi, which fact is also clear from the interim order of the High Court of Karnataka in the petition said to have been filed by the six swamijis of Ashta Maths, Udupi, challenging the inclusion of Sri Krishna Math under Karnataka Act 33 of 2001.'' "The documents also reveal that the Sri Krishna Math is constructing `Kanaka Gopura' after obtaining permission from the Municipal Council, Udupi. "The pamphlet produced by the plaintiff said to have been published by the defendant (Basavaraja Devaru) and daily newspaper would support the apprehension of the plaintiff that there is threat and danger to the property of Sri Krishna Math, if an ex parte order of temporary injunction is not granted. "Under the circumstances, if notice is ordered, the very object of granting temporary injunction would be defeated by the delay. "As there are prima facie materials and keeping in view the gravity of consequences in the absence of any interim order, ad-interim ex parte temporary injunction is granted in favour of plaintiff (Vishwapriya Tirtha), restraining the defendant (Basavaraja Devaru), his men and followers and all those persons claiming through or under him, from entering Udupi city in furtherance of `Kanaka Gopura Sangharsha Yatra' proposed by the defendant, till the next date of hearing." The court also issued summons to the defendant returnable by November 16.
