Notice issued to Reliance Telecom

By Our Legal Correspondent

NEW DELHI, NOV. 19. The Supreme Court today issued notice to Reliance Telecom Ltd (RTL) to show cause why it should not be fined Rs. 1 crore for not seeking permission to lay fibre optic cables in the Madhav National Park in Madhya Pradesh.

A three Judge Bench comprising Justice Y. K. Sabharwal, Justice Arijit Pasayat and Justice S. H. Kapadia issued the notice on the basis of the recommendations of the Central Empowered Committee constituted for the protection and preservation of forests. The Committee had stated that the Centre's approval was necessary for laying the lines under the Forest Conservation Act. In its defence, RTL said laying the cables had not affected the animal habitat of the park. No trees were felled during the laying of the cables and no damage was caused to the animal habitat. The Committee, however, found the RTL guilty of violating norms. It wanted the company to deposit Rs.1 crore in the Compensatory Afforestation Fund.
