dated November 24, 1954: Preventive Detention Act

The Home Minister, Dr. K.N. Katju, introduced in the Lok Sabha on November 23 a Bill extending the life of the Preventive Detention Act by three years. The Opposition raised objections to the Bill at the introduction stage itself, but they lost by 146 votes to 36. Only one member, Mr. K.K. Basu (Communist) got a chance to speak for the Opposition. He said that preventive detention should be resorted to only in an emergency, and today there was no emergency in the country. Dr. Katju replied that he did not accept Mr. Basu's proposition that this was an extraordinary law meant to be used only in an emergency. Preventive detention was provided for in a variety of ways in the Criminal Procedure Code and was envisaged in the Constitution. He described as utterly unfounded and utterly baseless Mr. Basu's charge that the Act had been used to put down political opponents. The Home Minister contended that on account of its psychological effect, the Preventive Detention Act was an extremely effective measure for the maintenance of law and order. Mr. Basu recalled that when the Bill was first introduced in Parliament in 1950, the then Home Minister, Sardar Patel, said the situation in the country was such that it was necessary to have such a law. In 1952, when the present Home Minister introduced a Bill seeking further extension for two years, he narrated certain incidents and argued that conditions in the country demanded continuation of the Act for some more time. But today there was no emergency whatsoever. In his reply, Dr. Katju said that when the time comes he would explain the situation before the country and lay facts and figures in Parliament.
