CHENNAI, NOV. 25. The Madras High Court today dismissed a habeas corpus petition (HCP) filed by an advocate seeking to set at liberty the Kanchi Sankaracharya [without his consent or instruction] after the lawyer unconditionally apologised to it. A Division Bench comprising Justice M. Karpagavinayagam and Justice S. Ashok Kumar said the petition filed by Wilfred Prakash was not maintainable. Clarifying that no exemplary cost was imposed on him because he was enrolled only recently, the judges pointed out, "he has also tendered an unconditional apology...In future the petitioner shall ensure that he concentrates on legal practice and indulges in legal activities." The judges referred to the petitioner's submission that he had not obtained authorisation from the Acharya to move the HCP, and said, "it is clear that he calls himself the next friend of the Acharya without any material to show that the pontiff had endorsed him as his next friend. By filing this petition, he has wasted the time of this court."
