BANGALORE, NOV. 30. The Bangalore Mahanagara Palike (BMP) has asked advertisers, who have put up hoardings after obtaining a stay from the court on the grounds of `deemed permission' as per the Karnataka Municipal Corporations (KMC) Act 443 (10), to remove the hoardings and seek fresh permission. As per the Act, an advertiser can approach the court and get an order for `deemed permission' if the BMP fails to respond to his application for permission to put up hoardings, within 45 days. The BMP's direction comes in the wake of a High Court order which upheld the civic body's case against Jagadish Advertising Agency recently. The advertiser had obtained a stay in 2001 on the grounds of `deemed permission' and the BMP challenged this. The advertiser removed the hoardings in question on November 24, according to a BMP press release. The High Court, in its order dated November 10, directed the BMP to ensure that the petitioner did not display hoardings without permission. The release said that if the petitioner complied with this requirement, the authorities could not pull down the structure on which hoardings were displayed.
