CoD probe ordered into impersonation case

BANGALORE, DEC. 7. The High Court of Karnataka on Monday ordered a Corps of Detectives (CoD) inquiry into an alleged incident of impersonation and fraudulent sale of land in a village near Belandur in Varthur hobli, Bangalore.

The petitioners, Kamalamma and her three children, B.G. Jeevanprakash, B.G. Gajendrababu and B.G. Lakshmiprasanna, had urged the court to direct the police to take cognisance of the complaint filed by them against impersonators who had tried to sell their land. The petitioners said they were the legal representatives of Guruva Reddy who owned two acres and 24 guntas in Devarabisnahalli in Belandur. They said a group of persons impersonated them and sold the land to Devireddi Basappa Dambal. The sale deed was registered before the Sub-Registrar, Koramangala.

The petitioners had registered a complaint on July 19, 2004 with the HAL Police about impersonation and fraudulent sale of the land. They had approached the court seeking a direction to the police to investigate the matter.

Justice K.L. Manjunath had ordered the police to investigate the issue and file a report.

When the matter came up today, the HAL Police filed an affidavit stating that on October 18, 2003 a notice appeared in a section of the media on the sale of land. The police said they managed to track down and arrest on December 2, 2004 Parvathamma alias Pali (57), her son, Poonacha, and another person, Shiva alias Chandrashekar. During investigation, Parvathamma confessed to having impersonated Kamalamma. She also revealed that Poonacha had impersonated as Gajendrababu and Shiva as Lakshmiprasanna.

All the three had appeared before the sub-registrar and impersonated the legal heirs of Guruva Reddy. Based on the information given by them, the police arrested Prakash Reddy (32) and Muniraju.

On December 3, Allama Prabhu Yalagi, the main accused, was arrested with Dambal.

Directed

A Division Bench, comprising the Chief Justice, Nauvdip Kumar Sodhi, and Justice B. Padmaraj, on Monday directed the Government advocate to file a statement on the number of junior doctors (interns) in Government hospitals in Bangalore. The Bench took exception to the fact that the Government had not filed a statement even though the case had been filed in December 1999. It also directed the petitioner, S. Vasudev, to file details about the status of junior doctors.

These directions were issued on a public interest litigation petition by Mr. Vasudev, an advocate, who had sought a direction to the authorities to take disciplinary action against the junior doctors who had struck work in December 1999 demanding higher stipend.

The petitioner said the strike had affected work in Government hospitals and put the patients to hardship. In some hospitals, no operation could be conducted. He said there were several Supreme Court rulings banning such strikes.

The Bench observed that doctors belonged to a noble profession and they could not hold people to ransom.

Adjourned

A Division Bench, comprising Justice S.R. Nayak and Justice B.S. Patil, adjourned a petition by P.S. Nagarale challenging the seat matrix for postgraduate dental seat matrix. The petitioner said the authorities had erred in arriving at the 80:20 seat matrix, though the Supreme Court had specified the matrix at 50:50. The High Court had upheld the petitioner's contention. The managements had approached the Supreme Court which had remitted the case back to the High Court.
