Lok Ayukta dismisses complaint against MLA

NEW DELHI, DEC. 15 . The Lok Ayukta of Delhi, Justice Mohammed Shamim, today dismissed a complaint against the Congress MLA from the Hastsal Assembly constituency, Mukesh Sharma, seeking inquiry into alleged amassing of properties `worth more Rs. 10 crores' by him after becoming a Member of the Delhi Assembly since 1993.

Dismissing the complaint filed by Vijay Tyagi, president of the Resident Welfare Association, Hastsal Vihar, Justice Shaim said: "The complainant has failed to show that respondent (Mukesh Sharma) has acquired properties/assets which are not in proportion to the known sources of income."

"I thus do not see any force in the complaint. It is liable to dismissed," Justice Shamim said in his nine-page judgment.

Counsel for the petitioner, Surat Singh, had submitted that the complainant had a valid case for a preliminary probe while counsel for the MLA, Vineet Malhotra, had urged the Lok Ayukta to dismiss the complaint at the initial stage as it was politically motivated and the allegations were too vague to be believed.

Justice Shamim dismissed a submission by Dr. Singh that the General Secretary of the Najafgarh District Youth Congress, Joginder Singh, had written several letters to the central leadership of the party regarding the misuse of the public funds by Mr. Sharma and that he (Joginder Singh) also lodged a complaint with a Joint Director of the Central Bureau of Investigation (CBI) regarding the alleged bogus payment of crores of rupees without doing any work in Mr. Sharma's constituency.

On the basis of the two grounds, Dr. Singh had contended before the Lok Ayukta that the MLA was a corrupt public functionary which the Lok Ayukta refused to entertain.

Dismissing the plea, Mohammed Shamim said: "I am sorry I am unable to agree with the contention of Dr. Singh. The MLA has placed on record a copy of the letter written by Joginder Singh to the CBI Joint Director where he (Joginder Singh) has denied to have made any such complaint." 0On comparison of the signatures of Joginder Singh on the said affidavit and on the letter adverted to above, they looked altogether different, Mohammed Shamim said.
