HYDERABAD, DEC. 15. A Division Bench of the Andhra Pradesh High Court, comprising Chief Justice, Devinder Gupta, and Justice M. Narayana Reddy, on Wednesday expressed disinclination to permit harvesting of organs from Venkatesh, who is ailing but not declared dead yet. The writ petition was filed by Sujatha who challenged the action of the authorities for not permitting transplantation of organs from her son. Mrs. Sujatha sought a direction to include those persons whose heart does not beat but from whom transplantation could be allowed.
The Bench pointed out that provisions of the Andhra Pradesh Transplantation of Human Organ Act which restrict the transplantation only to cases of brain dead had not been challenged and hence, the petition was liable to be rejected.
Earlier, the committee constituted as per provisions of the Act decided that Mrs. Sujatha's request cannot be conceded as her son is not brain dead.
