NEW DELHI, DEC. 18. The Chief Executive Officer of Baazee.com, Avnish Bajaj, was today remanded to judicial custody in the Delhi Public School MMS scandal case. Rejecting his bail application and remanding him to judicial custody till December 24, the Metropolitan Magistrate, Ms. Nivedita, said: "Investigation in the case is still in progress and the offence alleged does not warrant grant of bail to him.'' To an argument by Dinesh Mathur and A.S. Chandhiok, counsel for the accused, that their client had no liability in the case as he had taken due care in preventing the occurrence of the crime and that he had no knowledge of the circulation or sale of the video clip, Ms. Nivedita said that the court would consider it at the time of trial. Earlier, making submission, counsel for the Delhi police ended up creating a lot of confusion over the bail application of Mr. Bajaj. Initially, the Additional Public Prosecutor (APP), Inder Singh, conceded bail to Mr. Babaj submitting that he could be set free on bail after imposing three conditions on him of not leaving Delhi without prior permission of the court, joining investigation as and when called, and submitting his passport to the city police. Ms. Nivedita asked the APP thrice about his conceding bail to the accused and he gave his nod to that as many times. He even gave his consent to the MM's suggestion that she would record his submission regarding his conceding bail to the accused. Thereafter, the court concluded the hearing saying that she would pass her orders after going through the records of the case. However, after about half-an-hour, another public prosecutor, Pankaj Bhatia, appeared before the court and submitted that the city police were not conceding bail to the accused. Seeking judicial remand of the accused, Mr. Bhatia submitted that the court should decide the bail application on merit. However, he made it clear to the court that the police did not want custody of Mr. Bajaj because he had joined the investigation as and when called. Meanwhile, Amit Mathur, another counsel for the accused, told reporters later that his client would move a Sessions court against the MM's orders. The Economic Offences Wing (EOW) of the Delhi police had arrested Mr. Bajaj on Friday here after his interrogation in the case.
