BANGALORE, DEC. 22. The Karnataka High Court on Tuesday stayed the demolition of buildings by the Bangalore Development Authority (BDA) under the Arkavathi Layout scheme in Yelahanka and Kasaba hoblis. Justice A.C. Kabbin allowed the petitions by H.R. Lingappa, A. Rudrappa and others of Kempapura and Hebbala villages seeking a stay on the demolition of their houses. The petitioners said that they owned land in Kempapura village, Yelahanka hobli, and Hebbala village in Kasaba hobli. They said the villages were fully developed and there was no land for acquisition. However, the BDA on February 3, 2003 issued a preliminary notification under Section 17 (1 and 3) of the BDA Act acquiring the lands for the formation of Arkavathi Layout. The petitioners and others filed objections and told the BDA that no land was available for acquisition. Besides, they had already constructed houses on the land and were paying taxes to the Byatarayanapura Municipality, they said. They urged the court to set aside the order of demolition as it was arbitrary and illegal.
