CAT imposes fine on ICAR officials

NEW DELHI, DEC. 22. The Central Administrative Tribunal (CAT) has imposed a cost of Rs. 10,000 on the Indian Council of Agriculture Research (ICAR) and Agriculture and Cooperation (A&C) and asked the two public bodies to recover the amount from the Director-General, ICAR, Dr. Mangala Rai, and the Secretary, A&C, Radha Singh.

A Division Bench comprising the Vice-Chairman, Justice Kuldip Singh, and Justice S.A. Singh, Member (Administration), of the Tribunal passed the order on an application by B.S. Dhillon, Director, National Bureau of Plant Genetic Resources, New Delhi, of ICAR.

Dr. Dhillon had accused the two above-mentioned officials, who were on the interview board for the selection of Deputy Director-General (Crop Science), ICAR, as ex-officio members, of walking out of the selection proceedings and later making notes no the file recommending cancellation of the selection on the ground of it being not transparent.

The petitioner further alleged that the two officials had indulged in this practice with a view to stall his appointment to the post and that on their recommendations, the selection was cancelled by the Agriculture Minister, though the Agriculture Scientists Recruitment Board (ASRB) had okayed it.

Ruling on the conduct of the two ex-officio members of the selection committee, the Bench said: "The notes on the file by the two officials cannot be taken into consideration as they were not available to the Chairman and other members of the selection committee to comment upon or give their views. They are additions to the proceedings, as such, they cannot be considered to be dissent notes."

"We strongly feel that the two ex-officio members of the selection committee, through their notes, have made an unwarranted interference in the independence of ASRB," the Bench said.

"We are dismayed that the two ex-officio members of the selection committee of the rank of Secretary to the Government of India did not record their views as part of the selection proceedings but preferred to walk out and then proceed to have the recommendations of ASRB rejected by recording separate notes on the file," the Bench said.

"We imposed a cost of Rs. 10,000 on the respondents which is recoverable from the two afore-said ex-officio members of the committee," the Bench ordered.

The Bench also quashed the rejection of the selection, directing the respondents to place before the president, ICAR, the recommendations of the selection committee as forwarded by ASRB for taking a fresh view.
