NEW DELHI, DEC. 27. A Central Government Industrial Tribunal-cum-Labour Court has dismissed a plea by a peon of the Bank of Rajasthan seeking quashing of his termination from service, saying that his retrenchment was fair. Dismissing the plea by Ajit Kumar Jha, the Presiding Officer, R.N. Rao said: "... ..since the workman has not proved that he has worked for 240 days, he is not entitled to get any relief as prayed for.'' "The action of the management of the Bank of Rajasthan in terminating the service of the workman Ajit Kumar Jha with effect from 4-1-1996 is fair, justified and legal. The workman is not entitled to get any relief,'' the Tribunal ruled. The Ministry of Labour had referred the matter to the Tribunal for adjudication requesting it to decide whether the action of the management of the bank in terminating the service of the workman was fair, if not, what relief he was entitled to. In the claim, Jha through his lawyer V.N. Kakkar submitted that he had been in permanent and continuous employment of the management since July, 1991 against a permanent post of peon and his drawn wage was Rs. 1200 per month. He stated that the management had neither issued an appointment letter nor maintained any record of his service in order to grab his service and benefits.
