Court judgment on cheque bouncing cases

HYDERABAD, DEC. 27. A power of attorney holder can file criminal cases pertaining to bouncing of cheques on behalf of the persons who were given the cheque. This is the law declared by the High Court on Monday.

A bench of the High Court, comprising three judges -- Justice G. Bikshapati, Justice C.Y. Somayajulu and Justice Ch.S.R.K. Prasad -- delivered this judgment while answering a reference in this regard.

It may be recalled that the power of attorney holders were not permitted to file these criminal cases. On an earlier occasion a division bench declared that the cases filed by power of attorney holders are not maintainable.
