Court contempt plea dismissed
The petitioner, Chandragupta Sharma, through his counsel, Ravinder Raj, moved the Court seeking initiation of the contempt proceedings alleging that the school management had deliberately refused to implement an order by the Delhi School Tribunal asking the school management to reinstate the petitioner in service and pay him all his consequential benefits. The school management had dismissed Chandragupta Sharma, a music teacher, in 1989 on the charge of theft of a music instrument from the school. The Tribunal had ordered his reinstatement as well as payment of all his consequential benefits. Though the school management reinstated him but got a stay from the High Court on the payment of the payment of the consequential benefits. However, Mr. Raj in the petition blamed the school, Hira Lal Jain Senior Secondary School at Sadar Bazar in Central Delhi, of getting the stay order by hiding several facts of the case. He alleged that the school management kept away from the Court the facts that the teacher faced a criminal trial and was later acquitted and that he had filed a contempt of court case against the school management for not implementing the Tribunal orders. Dismissing the contempt petition, Justice Manmohan Sarin said: "Counsel for the school management submits that the petitioner has been reinstated. They further submit that the petitioner has not been paid the arrears in view of the stay granted by this Court in the writ petition. The stay order has been confirmed. In this view of the matter, no ground is made out for initiation of the contempt proceedings.
