Court pulls up man for marrying a minor girl

MADURAI, DEC.29. The Madurai Bench of the Madras High Court on Tuesday pulled up a 24-year-old husband of a minor girl for his "irresponsible act" of marrying her.

Hearing a petition filed by Rajesh Kumar of Madurai, pleading for a direction to the police to take his pregnant wife to hospital for treatment, the first Division Bench comprising Chief Justice Markandey Katju and Justice K. Govindarajan said, "Marriage is not for the weak, insecure and selfish, but you (petitioner) are all the three put together. When you are unemployed and not earning anything what will you feed her with. Marriage is not a joke, and not meant for people like you... You've made her pregnant and want the police to take care of her, wonderful! Is it the job of the police to look after pregnant women?"

The girl was confined in a home as per the earlier directions of the court on December 1.

Hearing a habeas corpus petition filed by the father of the girl the court had directed her to be sent to a home till she attained 18 years of age on May 25, 2005, since she was against living with her parents and expressed her willingness to go with her husband.

When this was brought to the notice of the Bench, the Chief Justice was quick to react, "The wish of a minor is immaterial. According to Section 3 of the Indian Majority Act, 1875, only a person who has attained 18 years of age is supposed to know what is good or bad to him. At the same time, the parents of a major boy or girl can in no way compel or confine them from marrying according to their wish, the maximum they can do is to break off social relationship with their children and nothing else."
