Bail denied in Katara case

NEW DELHI, JAN. 4. The Delhi High Court today refused to grant bail to Vishal Yadav, nephew of the former Rajya Sabha MP, D.P. Yadav, and one of the accused in the Nitish Katara murder case.

Dismissing his bail application, Justice B.N. Chaturvedi, said that the possibility of the accused, if enlarged on bail, influencing Bharti Yadav, daughter of D.P. Yadav, and one of the main prosecution witnesses, could not be ruled out.

Justice Chaturvedi stated that the accused could not be released on bail as Ms. Yadav was yet to be examined, noting that several prosecution witnesses had turned hostile in the case.

He also blamed Ms. Yadav for the delay in the trial observing that she had not appeared before the court for recording her statement despite repeated summons and warrants issued by the trial court.

Justice Chaturvedi also refused to modify his earlier order that no accused in the case could be granted bail in the case until Ms. Bhartri was examined by the prosecution.

Vishal Yadav had sought bail on the ground that he was incarcerated for two-and-a-half years and that his liberty was being curtailed due to the delay in the trial in which he had no role.

The trial court had in November last year dismissed an application seeking recall of a non-bailable arrest warrant (NBW) against Bharti Yadav.

The Additional Sessions Judge, D.S. Panwaria, had directed the prosecution to serve the NBW on Ms. Yadav and ensure her presence before the court on January 18.

Ms. Yadav is at present in Britain doing some professional course.

The prosecution believes that her examination will help unravel the motive behind the killing of Nitish Katara, son of a senior Indian Administrative Service (IAS) officer.

Vikas Yadav and Vishal Yadav, son and nephew of D.P. Yadav, are facing trial for allegedly kidnapping and later killing Nitish Katara in Ghaziabad in February 2002.
