NEW DELHI, JAN. 8. Shashi Dhar Sharma had a problem -- his motorcycle that refused to follow the "straight and narrow". Wobbling from the time he bought the new Kinetic Challenger motorcycle, he found that it was more trouble than he could handle. Tired of taking it back to the dealer to get it "fixed", he decided to go to court. However, the road to justice was longer than he expected as the company went in to appeal to the Delhi State Consumer Disputes Redressal Commission against the order of the district forum that had directed Kinetic Engineering Limited to refund the cost of the motorcycle. Dismissing the appeal in limine, the Commission stated that there was no ground to interfere with the impugned order. In his earlier case before the district redressal forum, Mr. Sharma had submitted that the motorcycle he bought wobbled from the moment he bought it. He also stated that the battery in the motorcycle was two years old and had been manufactured in September 1999, much before he bought the motorcycle. It stopped working soon after he bought the motorcycle, but the dealer refused to entertain his complaint. Tired of running from pillar to post, Mr. Sharma took Kinetic Engineering Limited to consumer court. After going through all the evidence, a district consumer court directed the company to refund the cost of the vehicle at 9 per cent for deficiency in service. , The company went in for appeal to the Commission which dismissed the appeal adding that there is no grounds to interfere with the impugned order.
