THIRUVANANTHAPURAM, JAN. 11. The Judicial First Class Magistrate III, Cherian K. Kuriakose, today dispensed with the examination of Sheikh Mohammed, a defence witness, in the case relating to the attempted molestation of the former Transport Secretary Nalini Netto by the former Transport Minister A. Neelalohithadasan Nadar. Mr. Mohammed was one of the persons Mr. Nadar's counsel had sought to be included as witnesses. The counsel had also asked the court whether video conferencing facility could be used to examine Mr. Muhammad, who is currently in Oman. In reply to the summons issued by the court, Mr. Mohammed wrote to say that he was trying to come to Thiruvananthapuram by January 25, subject to the availability of leave. He stated that he was not interested in video conferencing since it would invite unnecessary publicity. The magistrate said the reply of the accused did not indicate that he was willing to appear before the court and give evidence positively. The lack of interest of the witness in attending video conferencing indicated that he was disinclined to give evidence. The magistrate also dismissed a petition filed on behalf of Mr. Nadar, seeking more time for Mr. Mohammed to appear and testify. The petition referred to the High Court's direction to the magistrate to issue summons to the witness and to give him one month's time from the receipt of the summons to appear and give evidence. Dismissing the petition, the magistrate said the defence counsel had been granted more than a week's time on January 3 to prepare for argument in the event that the defence witness did not turn up today. There were no bona fides in the petition and it seemed to be aimed at delaying matters, the order said. The case has been posted for further hearing on Wednesday.
