CHENNAI, JAN. 12. The Tamil Nadu Government today gave an undertaking in a sessions court here that it would not arrest the Kanchi Acharya, Sri Jayendra Saraswathi, in the `Thirukottiyur Madhavan assault case' till January 20. The State Public Prosecutor, K. Duraisamy, gave the undertaking to the Principal Sessions Judge, P. Murugesan, before whom the Acharya's anticipatory bail plea came up for hearing today. Mr. Duraisamy informed the court that the Government preferred a fresh petition in the Supreme Court seeking stringent bail conditions for the Acharya. The matter was likely to be taken up for hearing on Monday. Though the petitions in the apex court and the present proceedings in the sessions court were different, the State would be able to present its case better if the anticipatory bail plea was listed for hearing on January 20, he said. Counsel for the Acharya, K.S. Dinakaran, said he had no objection to the adjournment of the case if the Government was ready to give a no-arrest undertaking. Accordingly, Mr. Duraisamy gave the undertaking, which was recorded by the judge. The matter was then adjourned to January 20 for further hearing. The Acharya filed the anticipatory bail petition yesterday. The judge adjourned the case by a day, with a direction that the Government must "obey strictly" the High Court orders against arresting the accused during pendency of their anticipatory bail pleas in court.
