PATNA, JAN. 24. The Patna High Court today directed the District Judge of Gaya, S.C. Jha, to probe the failure of police to arrest the Rashtriya Janata Dal nominee and former Minister, Surendra Prasad Yadav, when he filed his nomination papers despite the fact that three arrest warrants were pending against him. The Division Bench of the acting Chief Justice, Nagendra Rai, and S.N. Hussain, ordered the enquiry when the Gaya SP, Sanjay Singh, said that the arrest could not be made as the police had not received the non-bailable arrest warrants issued by a Gaya court against Mr. Yadav. Mr. Jha was directed to file his report within a couple of days so that the court could continue with its proceedings on the police lapses to arrest the absconding RJD candidate from the Belaganj constituency from where he is seeking re-election. The Bench said it would request the Election Commission to transfer the SP if his explanation was not found satisfactory. The Bharatiya Janata Party nominee, Mukesh Kumar, had filed the affidavit, charging that the Returning Officer was aware of the pending arrest warrants and had ignored them when the RJD leader filed his nomination papers.
