KOCHI, JAN. 27 . The State Government's decision to ban sale of all lotteries in the State has been challenged before the High Court. In his petition, Purushothama Bharathi, president, Kerala Lottery Agents Association, said the decision had been taken without considering the real issues involved in the matter. In fact, about 35,000 persons had been designated as recognised agents of State lotteries. Most of them were physically challenged and widows. He said it was owing to lack of proper supervision by the lottery directorate officials and other Government officials that had resulted in the Government losing revenue from the sale of other State lotteries and operation of online lotteries. The petitioner said the decision was highly improper and arbitrary. It violated Article 19(1)(g)(right to carry on business and trade) of the Constitution. The petitioner pointed out that the cases pending before the Supreme Court and High Court had arisen out of the disputes relating to the conduct of other State lotteries, including online lotteries.
Police protection
A Bench comprising Justice K.S. Radhakrishnan and Justice M.N. Krishnan ordered that police protection be given to A and N Hotel Enterprises Private Limited against obstruction being caused by CPI(M) supporters. The interim order was passed on a writ petition filed by the managing director of the company, Thomas Muthoot. According to the petitioner, he had obtained the title for the property measuring 2 hectares and 85 cents. He had constructed the hotel complex and entrusted its management to the Taj Green Cove Resorts. The four boundaries of the property had been well demarcated.
