Writ petition seeks panel to study tsunami

KOCHI, FEB. 1. A Division Bench of the Kerala High Court today issued notices to the State and Central Governments and other respondents on a writ petition seeking a directive to the Governments to set up a committee of experts in the field of hydrology, marine biology, coastal planning and managements to study the wave behaviour and make suggestions on preventive measures against tsunami destruction.

The notice was issued by the Bench comprising the Chief Justice, B. Subhashan Reddy, and Justice A.K. Basheer.

The petition filed by the Latin Catholic Aikyavedi sought a directive to the State Government to furnish statements of accounts of the money received towards the relief fund from individuals and other organisations. The petitioner also sought a directive to the State Government to effectively implement the rehabilitation measures for the tsunami victims.

The petitioner pointed out that sea walls were going to be constructed using the funds raised by the individuals and organisation. The construction would be carried out in an unscientific way and would only further endanger the lives of the people living along the coastal belts.

Lottery case

The petition challenging the ban on sale of lotteries in the State had been posted for February 8. The petitioner, Purushothama Bharathi, president, Kerala Lottery Agents Association, had contended the decision had been taken without considering the real issues involved in the matter.

Plea dismissed

A Bench comprising the Chief Justice, B. Subhashan Reddy, and Justice A.K. Basheer dismissed a writ petition seeking a clarification on a legal question whether a magistrate who had not seen the demeanours of witnesses and accused could pronounce a judgement in a sexual harassment case. Dismissing the petition filed by the Kerala Sthree Vedi, the Bench said that as per Section 326 of the Criminal Procedure Code, when the magistrate or judge who had already recorded evidence ceased to exercise the jurisdiction and was succeeded by another magistrate or judge, the successor may act on the evidence so recorded by his predecessor.

`Publish poll results'

Justice K.M. Joseph today ordered that the result of elections held to the posts of president, vice-president, treasurer and members to the executive committee of the Dakshin Bharat Hindi Prachar Sabha, Kerala unit, be published. The court had earlier restrained publication of the results.

Sex scandal case

A writ petition was filed seeking a directive to the State and Central Governments to entrust the monitoring of investigations into the Kiliroor sex scandal case and similar cases to the nodal agency constituted by the Central Government as per the directives of the Supreme Court.
