KOLKATA, FEB. 2. Rajendra Lodha, claimant to the Rs. 5,000 crore assets of M. P. Birla group, today sought initiation of suo motu contempt proceedings against the Birlas for allegedly trying to disrupt the proceedings of the probate matter by filing cases in different courts against him. Appearing for Mr. Lodha, senior counsel, Shaktinath Mukherjee, cited before Justice K. J. Sengupta case laws claiming that the court could initiate contempt proceedings against someone who tried to disrupt the case process by resorting to multiplicity of cases. Mr. Mukherjee, who was opposing the application by the Birlas for the appointment of an administrator in M. P. Birla group, claimed that the Birlas had initiated cases in a criminal court and also the Company Law Board to harass Mr. Lodha. He submitted that although three beneficiaries of the purported 1982 Will of Priyamvada Birla had not made any allegation against him, the other members of the Birla family were seeking appointment of an administrator in the M. P. Birla group companies. Mr. Mukherjee also submitted that Birla Corp had prospered under the stewardship of Mr. Lodha and its share value was on the rise and that the investors and shareholders had expressed confidence in him.
