BANGALORE, FEB. 3. The Bangalore Development Authority (BDA) on Thursday filed in the Karnataka High Court records relating to the acquisition of lands for the Arkavathi Layout. The BDA placed the records relating to the acquisition, statement of objections by the petitioners whose lands have been acquired and the awards passed by it. Justice Gopala Gowda, who is hearing the petitions by the residents of Hebbal, Yelahanka and surrounding areas of Kasaba hobli challenging the acquisition, had on February 1 directed the BDA to place the records before the court. The petitioners claimed that the acquisition violated the provisions of the BDA Act and the Town and Country Planning Act. The BDA said it was legal and did not violate any rule. The petitioners said there were differences between the preliminary and final notification of the lands to be acquired. They urged the court to quash the notification. The court adjourned further hearing on the petitions.

Justice N. Kumar on Thursday adjourned a petition by the Bangalore Mahanagara Pailke (BMP) challenging the auction of 15 acres and 11 guntas of land near the Byresandra Tank in Jayanagar. The BMP claimed that some persons had fabricated documents and mortgaged the bed of Byresandra Tank to a bank. When the persons failed to repay the money, the bank had issued a public notice for auctioning the land on February 4. The BMP urged the court to stay the auction as the tank bed belonged to the Government. It tabled documents of the Lakshman Rau Committee report and BMP records staking ownership of the tank bed.

A Special Bench comprising Justice S.R. Nayak and Justice Sreedhar Rao reserved orders on an appeal against a single-judge order relating to the Manipal Centre building on Dickenson Road in Bangalore. A resident of Bangalore, Ameena Moosa, had petitioned the High Court against the violation of certain bylaws by the builders of Manipal Centre. She had urged the court to direct the authorities to demolish the portions that violated the bylaws. A single judge had ordered the builders to remove structures within 16 metres of the boundary wall.
