Goa: BJP plans legal action

NEW DELHI, FEB. 4. The Bharatiya Janata Party has decided to fight the Goa case both legally and politically for it believes that the Governor's action in dismissing the Manohar Parrikar Government was "illegal and unconstitutional."

At a meeting this morning, chaired by the BJP president, L.K. Advani, it was decided that while the dismissed Chief Minister, Manohar Parrikar, would explore the legal avenues through a petition in the Bombay High Court, the party cadre would be galvanised to hold demonstrations throughout the country on February 8, to be observed as "Save Democracy, Sack Governor Jamir" day.

The party has already talked to the National Democratic Alliance convener and Janata Dal (United) leader, George Fernandes, who will get in touch with other NDA leaders so that all NDA parties may join the protest. In Delhi, a protest `dharna' on February 8 will be led by the former Prime Minister, Atal Bihari Vajpayee, Mr. Advani and Mr. Fernandes.

Briefing reporters, the party leader, Sushma Swaraj, dealt with the allegation that the Speaker of the Goa Assembly had wrongly prevented one independent MLA from casting his vote during the trust motion moved by the now dismissed Parrikar Government.

"Even if the Speaker had done something wrong, there were only two options open to the aggrieved party: remove the Speaker through a no-confidence motion or move the court against the Speaker's ruling."

"The Speaker's wrong cannot be righted by the Governor's wrong," she maintained. If the Speaker had done wrong by not allowing an MLA to vote, the Governor had no power to dismiss the Government ignoring the Speaker's ruling that the Parrikar Government had won the trust vote.

She regretted that a BJP MLA who had resigned from the Assembly recently had been made a Minister in the new Rane Government. This was against the spirit of the new legislation that prohibited giving a public office to a defector to entice him, she said.

Asked why the Parrikar Government did not resign and recommend new elections after four party MLAs had resigned, she said, "We are always ready for an election."

She said the BJP did not expect the new Government in Goa to last more than a few days. If the BJP had the support of 18 members in a House of 36, the Congress had also claimed the support of 18. "And if they have their own Speaker, they will lose one MLA like the BJP did," she claimed.
