NEW DELHI, FEB. 14. The Supreme Court today directed the Central Bureau of Investigation (CBI) to file the evidence on the basis of which it had decided to close the criminal case against the former Uttar Pradesh Chief Minister, Mayawati, in the Rs. 175-crore Taj Heritage Corridor project scam. When a three-Judge Bench, comprising Justice Ruma Pal, Justice S.B. Sinha and Justice S.H. Kapadia, asked the Solicitor-General, G.E. Vahanvati, how the CBI could order the closure of the case without the leave of the court, he submitted that the closure report had not yet been filed before the trial court. When the Judges said that the closure report should not be filed without the prior permission of the court, he gave an undertaking that no such report would be filed. The closure issue was raised by the amicus curiae in the case, Krishan Mahajan, who said the CBI's decision to withdraw the case had been widely reported in the media. Mr. Vahanvati said that the CBI had decided to withdraw the case on the basis of reports by various investigating officers and the opinion of the Attorney-General, Milon Banerjee.
