Chandraswami plea: Court issues notices to Centre, CBI

NEW DELHI, FEB. 16. The Delhi High Court today issued notices to the Union Government, Justice (Retd.) M.C. Jain, Chairman of the Jain Commission of Inquiry, and the Central Bureau of Investigation (CBI) on a petition by self-styled godman Chandraswami, seeking expunging of the entire contents of serial No.3 in the Action Taken Report (ATR) on the final report of the Commission of Inquiry which probed the facts and circumstances leading to the assassination of Rajiv Gandhi.

Justice R.C. Jain directed the respondents to file their replies by March 21.

Chandraswami, through his counsel, Santosh Chauriha, submitted that the Jain Commission was constituted on "baseless reports" and at the instance of Ramesh Dalal, Zile Singh Chauhan, Swatantra Sheel and Zafar Saifullah, witnesses before the Commission, and that the accusations were baseless.

He also sought a direction from the Court to the CBI asking it not to disturb him, his associates, friends and relations with notices under the garb of investigation.

The Multi-Disciplinary Monitoring Agency (MDMA) of the CBI, in the past seven years, could not find a "grain of evidence" to support the suspicion of the Commission, and therefore, had "no business to abuse the power of investigation by serving unwanted and unnecessary notices on him and his associates to join [the] investigation," the petition said.
