CHENNAI, FEB. 17 . Thanks to Mr. Justice M. Karpagavinayagam, the Madras High Court Advocates Association (MHAA) is richer by one rupee. Irked at the loss of court time due to a "frivolous" public interest litigation petition seeking immunity for religious heads from criminal proceedings, a Division Bench, comprising Justice Karpagavinayagam and Justice A.R. Ramalingam, dismissed the petition and said a cost of Rs. 50,000 would be imposed on the petitioner. When the petitioner-advocate, Kandasamy Singh, pleaded his inability to pay the sum, the Judges halved the cost. On further requests from the advocate, the Bench then asked him if he had a rupee on him. Mr. Singh readily put his hand into his pocket and fished out a one-rupee coin and agreed to pay the sum. Pulling him up for coming up with such a "publicity-interest petition," the Judges then directed him to go to the MHAA, pay the amount to the association president and bring the receipt. In his petition, Mr. Singh said the President and Governors enjoyed Constitutional immunity from criminal proceedings, and that the same should be extended to religious heads. He said no criminal proceedings should be instituted or continued against Christian, Buddhist, Sikh religious leaders and Kanchi Sankaracharayas.
