Court to hear Lakshmi Parvathi's plea on TDP dispute

NEW DELHI, FEB. 18. The Supreme Court will hear later this month a special leave petition filed by Lakshmi Parvathi, wife of the late N.T. Rama Rao, challenging a judgment of the Andhra Pradesh High Court rejecting a petition by the NTR-Telugu Desam Party against an order of a civil court relating to a property dispute with the TDP led by N. Chandrababu Naidu.

A three-judge Bench, comprising Justice N. Santosh Hegde, Justice S.B. Sinha and Justice G.P. Mathur, rejected the plea of Ms. Lakshmi Parvathi's counsel for early listing of the case. It said the SLP would come up for hearing in the normal course later this month.

On a suit filed by the TDP led by Mr. Chandrababu Naidu regarding the rights over certain properties, the Principal Senior Civil Judge, Ranga Reddy district, decreed in its favour. However, the High Court allowed an appeal from the NTR-TDP and remitted the matter back to the civil judge for fresh disposal.

`Real TDP'

This was transferred to the Principal Senior Civil Judge, L.B. Nagar, who decreed the suit holding that the majority of the people, including constitutional forums, had recognised Mr. Naidu as the real TDP and declared that the suit properties were exclusively those of Mr. Naidu's TDP and it was entitled for possession. On appeal again from the NTR-TDP challenging the orders of the Senior Civil Judge, the High Court also held that the TDP led by Mr. Naidu had rights over the said properties.

In her SLP Ms. Parvathi contended that the High Court failed to consider the substantial loss and injury to her if the stay was not granted, particularly when she was in possession of the suit property and continuing to run her party office and affairs as the successor of N.T. Rama Rao. She said the property was acquired by her late husband and she was in exclusive possession as his successor.

She said the decision of the Election Commission was only with respect to allotment of symbol and not with respect to which group was the real Telugu Desam. While so, the decision of the High Court was contrary to law, she said and sought stay of the impugned judgment and to restrain the TDP from dispossessing her of the property.
