Court summons MLAs' service report from Assembly

LUCKNOW, FEB. 18. The Lucknow Bench of Allahabad High Court today summoned service report from the Uttar Pradesh Assembly's Principal Secretary after 34 of the 40 rebel BSP MLAs failed to appear before it despite an earlier order.

The order was passed by Justices Jagdish Bhalla and M A Khan on a petition filed by BSP leader Swami Prasad Maurya.

In compliance with the Court order, six MLAs Kameshwar Upadhyay, Kazim Ali, Dharmendra Kashyap, Shyam Narain, Kunwar Vijyendra Pratap and Shailendra Yadav had appeared before the Bench along with their counsels.

The Court has now summoned the service report with regards to the other 34 rebel legislators.

On September 4, 2003, a splinter group of 40 BSP MLAs formed a new political outfit and later merged it with the Mulayam Singh Yadav-led Samajwadi Party.

The BSP had challenged the merger and prayed the 40 rebel MLAs be disallowed to attend the Assembly session, while September 6 and 8, 2003 orders of then UP Assembly Speaker Kesharinath Tripathi be stayed.

The Court has posted the case for further hearing on March 10 next.

On January 6 last, the court had ordered the 40 MLAs to appear before it and present their contention in the case.

The 34 MLAs who had not appreared before the Court so far include Rajendra Singh Rana, Yogesh Pratap Singh, Rajendra Singh Chauhan, Jai Prakash Yadav, Virendra Singh, Bhuwal Nishad, Jaiveer Singh, Surendra Vikram Singh, Vinod Kumar Singh, Jung Bahadur, Ram Swaroop Singh, Virendra Singh Bundela, Raj Kishore Singh, Rajpal Tyagi, Uma Kiran, Mahboob Ali, Nawab Qasim Ali, Qutubuddin Ansari, Dinesh Singh, Nathu Singh, Attaurehman, Ansar Ahmad, Mohd Bashir, Fashiha Murad Lari, Haji Yaqoob, Vimal Krishna Agarwal, Mohd Shafi, Uady Bhan Singh, Amarmani Tripathi, Matesh Chandra Sonkar, Ramji Shukla, Dharmapal, Surendra Singh Patel and Yogesh Singh.

The Bench has asked the Assembly Principal Secretary to present the service report till March 1 next. -- UNI
