Court notice to Mayawati on Kanshi Ram mother's petition

By Our Legal Correspondent

NEW DELHI, FEB. 21. The Supreme Court today issued notice to the Bahujan Samaj Party leader, Mayawati, on a petition from the 95-year-old mother of the party founder-president, Kanshi Ram, alleging that she (Ms. Mayawati) was keeping him under house arrest and not permitting the family members of the ailing leader to meet him.

A Bench, comprising Justice N. Santosh Hegde and Justice S. B. Sinha, issued the notice, returnable with four weeks, on the petition from Bishan Kaur. Earlier, appearing for Ms. Kaur, senior counsel Gopal Subramaniam alleged that Ms. Mayawati was preventing the ailing leader's mother and brother from meeting him at her residence. In the light of this submission, the Bench issued the notice to Ms. Mayawati.

Ms. Kaur challenged a Delhi High Court order, which rejected her plea holding that Mr. Kanshi Ram was living at the residence of Ms. Mayawati on his free will and without any pressure. The High Court had appointed one of the Registrars as the Court Commissioner, who recorded the statement. The BSP leader stated that he was living at C-1/11, Humayun Road, on his own free will and nobody had put any pressure on him for living there. After taking note of the Registrar's report, the High Court had dismissed Ms. Kaur's petition.

Assailing the High Court order, she said that the High Court had declined to interfere with her request to constitute a Commission of doctors and experts to ascertain the medical condition of her son.
