Orders tomorrow on Acharya's anticipatory bail petition

CHENNAI, FEB. 22. The principal sessions court here will deliver on Thursday orders on the anticipatory bail plea of the Kanchi Sankaracharya, Sri Jayendra Saraswathi, in the Tirukottiyur Madhavan assault case.

The judge, P. Murugesan, reserved orders after hearing counsel K.S. Dinakaran and the State public prosecutor, K. Duraisamy.

Mr. Dinakaran said Mr. Madhavan lodged a complaint three months after the alleged assault on August 3 last. After he was admitted to a private hospital, he told doctors that he suffered injuries in a road accident.

The Madras High Court, disposing of the anticipatory bail pleas from some other petitioners, held that the nature of injuries indicated that they were suffered in a road accident and that the Acharya might have been consulted on shifting the Siva idol from the Thirukkurunkudi temple in Tirunelveli district as the matter pertained to Saiva Agamas. The High Court also observed that the case "must be a foisted one," Mr. Dinakaran said.

Mr. Duraisamy contended that the case of the Acharya was different from the other accused. Many, including Mr. Madhavan, resented his "interference" in Vishnu temple affairs. Mr. Madhavan criticising such action resulted in direct, personal rivalry between the two, Mr. Duraisamy alleged.

`Justifiable delay'

As for the three-month delay in lodging the complaint, the prosecutor said Mr. Madhavan, caught between the might of an industrial group and an influential Mutt head, was afraid of approaching the police until the Acharya was arraigned as an accused in some other cases. The delay was due to justifiable reasons.
