Quota in constable recruitment upheld

NEW DELHI, MARCH 1. The Supreme Court has upheld the Tamil Nadu Government's policy providing 10 per cent quota in the recruitment of police constables for legal heirs of police personnel, ministerial staff and those who have been invalidated on medical grounds.

Allowing an appeal from the State Government, a Bench of Justice Arijit Pasayat and Justice S.H. Kapadia set aside a judgment of the Madras High Court quashing such a policy decision.

The Tamil Nadu Service Recruitment Board issued a notification on March 5, 2000 calling for applications for filling 1,155 posts of police constables, Grade II. The notification said 10 per cent of the posts would be reserved for children of police personnel. M. Senthil Kumar, who was not successful in the selection, moved the Central Administrative Tribunal, which rejected his application. He filed a writ petition in the High Court and a single judge while dismissing it held that the preference shown to legal heirs of police personnel was unconstitutional. The Bench said there was no challenge to the constitutional validity of the policy and the tribunal had disposed of the application on the ground that he was not suitable for selection.
