Madurai
By Our Staff Reporter
MADURAI, MARCH 3. Not inclined to peruse the report filed by the Central Bureau of Investigation on the alleged abduction of Jayalakshmi's family by a few policemen, the Madurai Bench of the Madras High court today handed over the report in a sealed cover back to the agency and directed it to file it before the magistrate concerned. However, a Division Bench, comprising Justice P.K. Misra and Justice Prabha Sridevan, granted one more month's time to the agency to file a final report in another case probed by it based on an affidavit filed by the Sivakasi woman alleging sexual harassment by the police. The matter was adjourned to April 4. Arguing for the CBI, the special public prosecutor, E. Jacob R. Daniel, submitted that though the investigation in the sexual harassment case was also completed, the agency could not file the report since it was under scrutiny before its superior officials. "A total of 175 witnesses have been examined and 390 documents collected in this case. The statements and documents have to be examined by senior officials in the CBI. We would file a full and complete report in this case also if four weeks' time could be granted to us." Treating a telegram sent by Jayalakshmi's father to the Chief Justice of the Madras High Court as a habeas corpus petition, the Bench, on October 1, directed the CBI to probe the matter and file a status report within two months. Accordingly, the agency registered two cases one pertaining to the abduction of Jayalakshmi's family by policemen and the other based on the affidavit filed by her alleging sexual harassment, bigamy, corruption, intimidation, rape, threat to foist cases and forced marriage against more than twenty police officers. A status report was filed on December 1, 2004 and the agency was granted time till March 6 to file the final report in both the cases. Subsequently, the CBI filed its final report yesterday in the abduction case alone along with an application seeking more time to file a report in the sexual harassment case.
