Court directs publication of notices to BSP MLAs in newspapers

LUCKNOW, MARCH 10. The Lucknow Bench of the Allahabad High Court today directed publication in newspapers of notices served to 26 of 40 Bahujan Samaj Party MLAs who had not yet received them in connection with a writ petition seeking to quash their assembly membership.

A Division Bench of Justice Jagdish Bhalla and Justice M.A. Khan directed the petitioner to get the notices of 26 of the 40 MLAs published in newspapers till April 11.

The court directed that the notices be published in a Hindi newspaper from Lucknow and one newspaper, each having largest circulation in their respective constituencies. The notices should also be sent to these MLAs by registered post.

April 11 had been fixed as the next date of hearing.

The petition, filed by the BSP Legislature Party leader, Swami Prasad Maurya, sought quashing of the then Speaker, Kesari Nath Tripathi's order recognising the splinter group and dismissal of membership of these MLAs under the anti-defection law.

In September 2003 Mr. Tripathi recognised these 40 MLAs as belonging to the Jantantrik Bahujan Dal and two days later accepted their merger with the Samajwadi Party.
