CHENNAI, MARCH 21. The former BCCI president, Jagmohan Dalmiya, and the honorary secretary, S.K. Nair, who were supposed to appear before a city civil court here today, did not turn up on the ground that no notice for contempt of court had been served on them. When the matter came up before the VI Assistant City Civil Court Judge, M. Mohaideen Pitchai, senior counsel for Mr. Dalmiya, Siddharth Shankar Ray, submitted that he came to know of the contempt case only through the media and that till today neither a court notice nor private notice had been served. Mr. Ray said he would need some time to study and file a counter. When M. Selvaraj, counsel for the Chennai-based Sir Theyagaraya Recreation Club submitted that Mr. Dalmiya and Mr. Nair were aware of the court order directing them to appear in person today and that the Madras High Court had declined to interfere with the order, A.L. Somayaji, senior counsel for Mr. Nair, said the High Court had merely asked him to file an application instead of mentioning the matter orally. The Judge then permitted the Club to file an additional affidavit, and posted the matter to March 28 for filing of counter.
