Bench transfers probe to CB-CID

MADURAI, MARCH 31. "Surprised" at the slow pace of investigation done by the Gandarvakottai police in Pudukottai district in a case registered under Section 174 Cr. P. C. (police to enquire and report on death under suspicious circumstances), the Madurai Bench of the Madras High Court today transferred the case to the Crime Branch - CID in Pudukottai.

"It is highly surprising that though the occurrence took place on September 15, 2004 and the case was also registered, only three witnesses have been examined so far and that the post-mortem report is yet to be received. Hence, it is a fit case to be transferred...and the CB-CID is directed to conduct a full-fledged investigation in order to unfold the truth," Justice M. Chockalingam observed in his order.

According to the petitioner, Saravanan (31) of Kadavarayanpatti in Pudukottai district, his father was found dead in an oil mill in their village in the early hours of September 15. Since the deceased was found with injuries on his scrotum, the petitioner preferred a complaint with the police alleging that his relatives, who had a long pending land dispute with his family, might have killed his father. Even a sniffer dog, which was brought to the scene of `crime,' ran to one of the relative's house, he said.

In spite of preferring a complaint with specific allegations against seven of his relatives, the police merely registered a case under Section 174 of Cr. P.C. in order to help the accused escape punishment and were trying to close the case by declaring it a natural death, the petitioner alleged.
