KOCHI, APRIL 8 . The Kerala High Court Judge and Executive Chairman of the Kerala State Legal Services Authority, K.A. Abdul Gafoor, today said the authority was ready to organise an adalat to settle arbitration cases. Inaugurating a national seminar on `Legal and Technical Aspects of Arbitration' organised by the Indian Institution of Technical Arbitrators, Kerala State Centre, he said arbitration was part of the Alternative Disputes Redressal System. Arbitrators acted as umpires in the disputes. In fact, arbitrators were being appointed as per the agreements entered into between two parties. The finding of the arbitrators was binding on all the parties. He said the Alternative Disputes Redressal System had assumed greater significance in the context of globalisation. It would do away with prolonged litigations and provide speedy justice at lesser cost. Besides, it would also improve the administration of justice, he said. The Alternative Disputes Redressal System includes negotiation, mediation, conciliation and arbitrations. The negotiation process involved the principles of give and take while mediation was a cooperative problem-solving process.
Business disputes
The mediation process could be effectively used in business and commercial disputes. The conciliation process was undertaken with the assistance of experts in the relevant field. It could be resorted to settle family and industrial disputes. He said that before resorting to arbitration proceedings, the contractors and others could seek mediation and conciliation methods to settle the disputes. The Thiruvananthapuram Railway Divisional Manager, G. Narayanan, delivered the keynote address. M.C. Bhide, president, Indian Institution of Technical Arbitrators, presided. Mr. O.P. Goel, former Director of the Central Public Works Department (CPWD), and Brig. H. K. Dadhich, Chief Engineering, Naval Academy Project, Ezhimala, Kannur spoke.
