Bar Council polls to be held in September

KOCHI, APRIL 10. With the appointment of K. Narayana Kurup, the former Acting Chief Justice of Madras High Court, as returning officer, the stage has been set for elections to the Bar Council of Kerala.

The Council that met last week also decided to appoint four former district judges as assistant returning officers, according to K. Mohandas, chairman of the Bar Council. As many as 24,000 lawyers who had already paid their dues to the Bar Council of India Welfare Fund will participate in the elections.

The Bar Council had decided to publish the preliminary electoral rolls on May 15. The final roll will be published after considering the objections to the roll.

Election dates

The elections will be held on four days. The Bar Council had tentatively fixed the election dates as September 22, 24, 26, and 28. The elections are to be held at 75 polling booths spread across the State. The advocates would elect as many as 25 members to the Council, who in turn would elect the office-bearers, including its chairman, Mr. Mohandas said.

The Bar Council is being constituted under provisions of the Advocates Act.

The functions of the State Bar Council include admission of persons with law degree as advocates on its roll, determining cases of misconduct against advocates and safeguarding the rights, privileges and interest of advocates. If the State Bar Council has reason to believe that any advocate on its roll has been guilty of professional or other misconduct, it shall refer the case for disposal to its disciplinary committee.

After giving the advocate concerned an opportunity to be heard, the disciplinary committee of the Bar Council will either dismiss the complaint, reprimand the advocate or suspend him from practice for such period as it may deem fit, or remove his name from the State roll.

If an advocate is suspended from practice, he/she shall be debarred from practising in any court or before any authority or person in India during the period of suspension.
